CHAPTER 4
AN EXAMPLE TEMPLATE FOR RESTORATION
At one point, should you and your Freeholders decide to shed an out-of-control government, be it local, state wide or at the national level, you may need to examine how far away you are from the point of our foundation and its principals. At the time of this writing, The Commonwealth of Virginia (my main focus) is on its Seventh iteration of a Constitution county the one used in the War Between the States. No Constitution is perfect and the people’s hue and cry, as it becomes the force of “The Public Weal”, needs to have leeway and precedence in the discharge of the powers of civil direction to avoid the continence of a Jacobin style system, which will just repeat the miseries and the tyrannies you are trying to escape.
Here are some points to consider from my own perspective when (not if) the day comes you and your neighbors are faced with the decision to abandon your government(s) and start a new one. These ideas I provide here are not set-in stone, even with myself. No battle plan, ever lasts a war. As we have learned by the year 2021, no Constitution lasts forever, however as it is also said, failing to plan, is a plan for failure.
The items I give you here, were pulled from our founders moves and justifications, which I see as still valid today. These ideas also take into account, that our nation is not physically the same in the sense of technology and the number of inhabitants we have here. For example, what ever happened to that ratio of representatives premised in the Constitution such as was first written about in Thomas’ Pain’s “Common Sense”? [1] It was consumed by a clause that allows Congress to make up the rules that govern itself. These are the same rules, a new Constitution could do away with and let us try to resume the original idea of the founders, which was cut short by the creation of the Nation State or national government.
You may not want to replace an entire government. You want to reform sections of it. All of these are your right and your duty for a better existence and legal under the protection of the Declaration of Rights [2] (or as it is known from the practice of pigeon-holing by the 1789 Federalists, “The Virginia Declaration of Rights”) You should resurrect the Association of Freemen and Freeholders from our founders’ time. Inside that Association, you would have a General Committee and that would control all votes a main body. Let the Boards and Committees that your government now run, be abandoned and lay judgment on your governments from committees of The Public Weal. It is your right and your duty.
Example One:
Our people in Virginia, are currently taking the lessons of out-of-control governments and have a plan to replace that type of government, which was left behind by the model of Reconstruction. The aim to abandon the old state (or possibly even local governments who go along with them) and start new and less intrusive ones. We are currently reviving the power of the Freeholders in the participating counties to accomplish this task.
Because the population of our state has grown so much, we desire a more intimate relationship with our representatives in government as an unchanged form of government has grown distant from us. To achieve this, we need a much smaller number of people to be represented by these chosen people over our current situation. This would require a House of Delegates to be numbered in the several hundred or a thousand rather than one hundred. It would make it more complex for the foreign powers to rule the state from a far. With so many hands being held out for a pay off to be traitorous to their own people, their goals would be too numerous to be focused on our destruction.
Things are so populated here, that we need the counties to divide up their Freeholders groups by zip code and then each zip code should elect a selectmen type of delegate to a higher body of the people, in the name of “The Congress of Counties”. Such a Congress, can be made up of the people’s people and stand as a direct overseer of the Executive Branch, Legislative Branch and Judicial Branches. It should have the power of all three branches in the way of checking power without having the job of creating legislation.
The local groups must have face-to-face elections that have no political party infiltration. One of the first regulations the Freeholders groups must create is that the political parties are to be made unlawful.
The Congress of Counties, should be a permanent body and never be allowed to disappear but never expanded and always be run by the people of the counties and their zip codes.
The Congress of Counties, upon their creation, must take on the task of creating the new Constitution Draft and have it ratified back through the Freeholders groups in the zip codes and counties. No other branch of government need be or should be allowed to touch it or that process.
It is all to be done peacefully. No violence is to be designed, funded or put forward to achieve the goal. The Government employees, who are not part of the command-and-control structures, should not be blamed for the destruction of our nation. However, a line must be drawn in the sand with them. Therefore, any Declaration that dissolves the old government to make way for a new government, should make the statement that promises to not fire them on the day the new government is declared open and their salaries would be honored as would be their retirements if those Government employees who are willing and wanting to join their real fellow American citizens in the process. Those who wish to fight Life, Liberty and the Pursuit of Happiness in it’s 1776 form, should not be given such considerations. No two-timers allowed!
Example Two: LCC (Local Constitutional Committee) would be, made up of any citizen who is not in a political party or an elected official or an appointed official. Only regular citizens should be allowed in attendance and decisions should be made by simple majority which gives true representation of hue and cry. (the part of our Democratic-Republic design that has been crushed since the conclusion of the Civil War) This precedence position comes from the ownership of the power to create the government and that comes from the people as outlined in the Virginia Constitution Article 1 Section 1 and the right to assembly of the people comes from Article 1 Section 12. This body can be placed in or act as the “Congress of Counties” from Example 1.
Example Three: Actions and Process power come from Article 1 Section, which defines the power of the public weal and who is under it. Article 1 Section 3 gives the public weal the power to makes changes of any kind that it wishes. This can include vacating or reversing a decision in the courts. It can include reversing a decision of a council or a board and can include voiding a local ordinance or code which a Congress of Counties or LCC deems unconstitutional. It can overturn the orders of any executive such as a Governor, Chairman or Mayor. If the Congress of Counties or LCC findings require enforcement of the public weal against an insubordinate public servant or servants, it has the power under Article 1 Section 13 to support enforcement of its ruling.
Create your Local Constitutional Committees based on Citizenship and by your zip code+5 in your county, town or city, but make sure you write that map in stone and any additions from the Post Office in the future will have to be approved the Association General Committee.
Allow no persons to attend who are elected or appointed government servants. Allow citizens who are members of political parties only if they sign an agreement with the LCC that they denounce their membership and profess that there is no party that stands between you and your constitution(s). It may sound draconian; however, you are taking the position of defending your ground. Never feel as though you are being a tyrant for defending your way of life from somebody who is fighting to get inside of it and dilute it. If they don’t like it, tell them to go to hell.
If your state does not have a Bill of Rights such as Virginia’s then you can use the freedom to assemble and the creation powers of the people to make your government accept the results from an ancillary Bill of Rights Convention and create resolves that spell out your new additions to your Bill of Rights that gives you the power in the light of the Virginia Declaration of Rights. As it stated for our founders, ALL LAWS out to be equal and you demand to be equal with the other states. That document, The Declaration of Rights from the good people of Virginia, takes precedent over all others in this nation. Consult your state Constitution carefully as the power may already exist but does not necessarily look exactly like Virginia’s.
Local bodies probably should not be structured to take the place of legislative bodies in the creation of new laws. They should retain the power of overturning anything they deem as actions against them from legislative bodies, such as the creation of Ex Post Facto Laws. This takes away the long-abused practice of the spirit of law that drags us all before a court to decide if something Ex post facto of our rights. This loophole is placed onus b Alexander Hamilton’s carefully crafted platitude called Federalist Number 78, where he assures the reader that no such laws will be made, however if called into question, it is up to a court to decide, rather than logic being the dictate of legislative bodies. One only has to remember, the “Federalist Papers” as they are known, are not in any Constitution by wording, therefore, they are only a wish list to Santa Claus and I am sure he will leave them under the tree, next Christmas rather than leave our fates in the hands of Judicial Tyranny.
These LCC bodies, would have the power to order, without any obstructions, an immediate recall election if need be or overturn a civil case ruling. The bodies must also have the power to remove or recall any elected or appointed official in any level of Government.
These bodies would have plenary power over the governments only and not the people. The three original branch design can remain intact if wanted and can now be “managed” and allow the elimination of the Senate body. An expansion of the House of Delegate would allow the seat of the Public Weal in the form of a Separate Congress of Counties. We now have an improved four branch government with the original three branch system being diminished in size and in power, more desirable as would be found in the 1776 expectations.
To ensure your children continue their education as you abandon the Public Education system (which you will and as you eventually stop paying taxes to the abandoned government) you can form Home School networks in your area that eventually, through your Congress of Counties, can form a bond across the state that provides a joint recommendation for a study curriculum. That must be a recommendation and not a forced doxy, unlike the kind you are presently trying to escape. Be careful not to become what you will defeat!
As the late Senator Barry Goldwater noted in his book “With No Apologies”, after they created a new town charter, they made sure they had a system to collect taxes to run the new government, as they also stopped paying taxes to the old government. [3] It will not be easy but you have to do what generations of Americans before you, did not do and that was to be conned into trusting those political parties that they only had to go vote for on election day. Then all you could do after that was to sit around and forget about being directly involved in your governments! [4] At least that’s what we’ve been told.
If any detractors try to tell you that what you seek to do, is to revert back to a “non-energetic government”, then you must ask them to clarify that and compare their answer to items on a detractor list of your own. Do they define an energetic government that implodes your economy, implodes your borders, allows and promotes the killing of born and unborn countrymen, allows and promotes the tenants of our Christian ethics and beliefs to be destroyed and perverted into a new form of normalcy? Those positions are coveted by those who embrace the creation of Marx and Durkheim known as “Sociology”, which allows and promotes the forced Nazi like poisoning of our bodies with genetic mutations from drugs called “vaccines” by a eugenics medical tyranny.
The poisoning of our people has included changes of our food industry, which places poisoned products on the dinner table. Similar such actions purposefully destroy personal ingenuity, inventiveness and allow the gathering of property to be turned over to foreign companies and governments, so that our wealth can be ripped from our lives, etc. One must speak the truth to these detractors and tell them, you have had enough of their lies and their intellectual laziness.
Anything is possible, as long as you put the power of government back in your hands and forever pledge to tend to it as you would your own food garden. Here are some wise words from the late Congressman Martin Dies’ book, on the subject of tending your political garden:
